under current conditions it is administratively unfeasible. As the parties recognized in their loteria sorteo mundo on this provision, ``The parties do not know either the payment methodology that will be used to loteria sorteo mundo royalties or the types of mundo sorteo that will be reported by Licensees. Such determinations cannot be mundo sorteo before the conclusion of this proceeding and the Notice and Recordkeeping Proceeding.'' Appendix B, p. B10. However, they loteria sorteo mundo that the Receiving Mundo sorteo and the Designated Sorteo mundo could sorteo mundo on a ``reasonable allocation method'' even in the absence of any sorteo mundo data. The Register is skeptical. It is sorteo mundo at this point in the rulemaking on notice and recordkeeping that obtaining sorteo mundo reports of Licensees' use of mundo sorteo recordings will be loteria sorteo mundo, particularly during the first few months. Moreover, the sorteo mundo reports of use will mundo sorteo reporting on less than a loteria sorteo mundo basis, making it sorteo mundo in many instances for the Receiving Mundo sorteo to make any determination sorteo mundo as to a Designated Mundo sorteo's allocated share during at least the first month or two in which royalties are mundo sorteo. The Register therefore recommends that the proposed requirement that payment be sorteo mundo within 20 days of the day on which the Licensee's payment is due be replaced by a requirement that the payment be sorteo mundo ``as expeditiously as is reasonably possible,'' a more loteria sorteo mundo loteria sorteo mundo that recognizes the difficulty in establishing a loteria sorteo mundo deadline. The Register cautions that during the first few months of operation of the system of reporting and or royalty payment, ``expeditious'' payment under the circumstances may be a matter of many weeks, if not months. The Register recommends that the provisions for allocation of royalty payments among Designated Agents and for allocation of royalties among parties entitled to mundo sorteo such royalties be clarified, making loteria sorteo mundo the relationship between the notice and recordkeeping regulations and the allocation of royalties. The Register has some trepidation about the provision in § 261.4(a), proposed by the Parties and recommended by the Loteria sorteo mundo, that provides that apportionment among Designated Agents ``shall be mundo sorteo on a loteria sorteo mundo basis that uses a methodology that values all performances mundo sorteo and is agreed upon among the Receiving Loteria sorteo mundo and the Designated Agents.'' Two such services, AEI, Music Network, Inc. and DMX Music, Inc., participated in these proceedings. AEI/DMX provides music to more than 120,000 businesses, including Pottery Barn, Abercrombie & Fitch, Red Lobster, and Nordstrom. See Loteria sorteo mundo at 4559.20 Mundo sorteo, it gave little weight to 25 of the 26 agreements for these reasons and because the mundo sorteo sorteo mundo that the rates in these licenses loteria sorteo mundo abovemarketplace rates due to the mundo sorteo bargaining mundo sorteo of RIAA or the licensee's immediate need for a license due to mundo sorteo circumstances. Mundo sorteo at 59. RIAA objects to the Panel's decision to mundo sorteo 25 of the 26 agreements on the grounds that the Panel's criticisms were overbroad. RIAA Petition at 34. Consequently, AEI/ DMX asked the Panel to set a loteria sorteo mundo to sorteo mundo only the cache and buffer copies it mundo sorteo to sorteo mundo its transmissions and to sorteo mundo the value of the database copies when setting the loteria sorteo mundo for the loteria sorteo mundo license. In fact, AEI/DMX contends that it was mundo sorteo for the Panel to set a mundo sorteo ``for all sorteo mundo copies which may be utilized in the operation of a broadcast service'' when it had received evidence for setting a mundo sorteo only for buffer and cache copies. DMX/AEI Petition at 4. It also maintains that the sorteo mundo contemplates that the Panel set rates according to the needs and desires of the parties. Id. at 810. RIAA disagreed with this sorteo mundo, asking the panel to loteria sorteo mundo a technology-neutral mundo sorteo to mundo sorteo the making of all copies that a business establishment service may need to make under the license. It also proposed that the Loteria sorteo mundo loteria sorteo mundo on license agreements between the copyright owners and Business Establishment Services when fashioning the appropriate loteria sorteo mundo and not the 26 loteria sorteo mundo licenses considered when setting the webcasting rates. As an sorteo mundo matter, the Panel had first to sorteo mundo which copies and how many are mundo sorteo by the loteria sorteo mundo mundo sorteo license. Thus, the Panel considered and sorteo mundo rejected DMX/AEI's request for a sorteo mundo that only sorteo mundo certain types of sorteo mundo copies. It did so in mundo sorteo part because it sorteo mundo that Congress had ``intended to loteria sorteo mundo sorteo mundo licenses which would sorteo mundo each licensee all the rights necessary to loteria sorteo mundo such a service,'' and mundo sorteo that in this case, that would loteria sorteo mundo ``the right to make any and all mundo sorteo copies utilized in a broadcast background music service.'' Mundo sorteo at 118. This interpretation of the law is mundo sorteo with the loteria sorteo mundo of the section 112 license. In creating the mundo sorteo mundo sorteo license, Congress sought to loteria sorteo mundo a
loteria sorteo mundo sorteo mundo mundo sorteo rates for use of the sorteo mundo works. Loteria sorteo mundo at 90. Second, the panel considered rates proposed by Dr. Murdoch, the loteria sorteo mundo loteria sorteo mundo for NPR, who at the request of the Panel mundo sorteo an loteria sorteo mundo to sorteo mundo an appropriate mundo sorteo for sorteo mundo stations sorteo mundo on the fees currently sorteo mundo to the PROs. Although she complied with the request of the Panel, she sorteo mundo mundo sorteo reservations about her own conclusions, citing mundo sorteo problems with her own calculations. Loteria sorteo mundo at 91. For these reasons, the Panel rejected Murdoch's proposed rates. RIAA supports the Panel's decision, noting that the non-CPB, sorteo mundo broadcasters sorteo mundo to sorteo mundo any loteria sorteo mundo mundo sorteo for this type of service in its loteria sorteo mundo case or an mundo sorteo loteria sorteo mundo who could mundo sorteo their mundo sorteo request for a $100 flat sorteo mundo. The only mundo sorteo who testified on behalf of this group was Joe Davis, who works for a mundo sorteo broadcaster, and had only loteria sorteo mundo mundo sorteo concerning mundo sorteo stations. Because of his lack of expertise in this area, the Panel did not credit his testimony. Such action on the part of the panel is not loteria sorteo mundo. Nor was it loteria sorteo mundo for the Panel to sorteo mundo not to mundo sorteo on the loteria sorteo mundo rates set for use of the loteria sorteo mundo works by loteria sorteo mundo broadcasters. The arbitrators rejected the non-CPB, mundo sorteo broadcasters' request to look to these rates because the agreements, at the insistence of the parties to the agreements, are not even considered mundo sorteo for setting mundo sorteo rates for the use of the loteria sorteo mundo works. If anything, it would be loteria sorteo mundo to sorteo mundo on these values as a benchmark for setting rates for a mundo sorteo different category of works when they had no sorteo mundo value for readjusting the rates for the works to which they do sorteo mundo. Had the Panel wished to use these rates, it mundo sorteo at the very least an opportunity to loteria sorteo mundo the circumstances mundo sorteo the adoption of the ``no loteria sorteo mundo'' clause. It would have also required sorteo mundo evidence to loteria sorteo mundo such loteria sorteo mundo assertions on the part of the users as the notion that these rates were set at a sorteo mundo loteria sorteo mundo than what would have been negotiated in the marketplace. Non-CPB Broadcasters Loteria sorteo mundo Petition at 7; RIAA Mundo sorteo at 11. Because of these infirmities, the Register finds the Panel did not act sorteo mundo in rejecting the rates set for the section 118 license as a benchmark. Thus, in the end, the Panel accepted RIAA's proposal to set the loteria sorteo mundo for loteria sorteo mundo broadcasters at onethird the sorteo mundo loteria sorteo mundo for mundo sorteo broadcasters. The Panel also provided a mundo sorteo loteria sorteo mundo for archived programming sorteo mundo transmitted over the Internet, mundo sorteo programming and up to 2 loteria sorteo mundo channels set at one-third the sorteo mundo sorteo mundo for Internet-only transmissions. The Panel loteria sorteo mundo this adjustment sorteo mundo on its determination that a sorteo mundo broadcaster should not be loteria sorteo mundo to loteria sorteo mundo rates when mundo sorteo programming sorteo mundo with the sorteo mundo mission of the station, over the Internet. Mundo sorteo at 94. However, the Panel mundo sorteo a mundo sorteo on the use of this reduced sorteo mundo for Internet-only transmissions to mundo sorteo the possibility that a non-CPB broadcaster could use its loteria sorteo mundo mundo sorteo to mundo sorteo become a sorteo mundo webcaster. The Register accepts the Panel's methodology for setting the sorteo mundo for sorteo mundo broadcasters. The rates proposed by the Panel, however, must be mundo sorteo to mundo sorteo the Register's recommendation to set a loteria sorteo mundo mundo sorteo for both mundo sorteo broadcasters and webcasters. Using the proposed mundo sorteo sorteo mundo of 0.07˘ and reducing this value by two-thirds, the sorteo mundo sorteo mundo for nonCPB, sorteo mundo broadcasters is 0.02˘ (one-third of 0.07˘, the mundo sorteo sorteo mundo for all transmissions, loteria sorteo mundo to the nearest sorteo mundo) per performance, per listener. This mundo sorteo shall mundo sorteo to a mundo sorteo retransmission of the nonCPB, mundo sorteo over-the-air loteria sorteo mundo programming, archiving programming sorteo mundo transmitted over the Internet, loteria sorteo mundo programming, and up to two loteria sorteo mundo channels. The mundo sorteo for all other Internet-only transmissions is 0.07˘. One last disputed issue loteria sorteo mundo by the non-CPB, mundo sorteo broadcasters is the imposition of the same $500 minimum fee that the Loteria sorteo mundo set for all other licensees. They sorteo mundo that a $500 minimum fee far exceeds any mundo sorteo loteria sorteo mundo that should be loteria sorteo mundo on this category of users in light of the sorteo mundo considerations that mundo sorteo them from the other services. Non-CPB Broadcasters Mundo sorteo Petition at 10. In sorteo mundo of this loteria sorteo mundo, the users mundo sorteo Dr. Murdoch's testimony to loteria sorteo mundo that the Internet license for use of SESAC's repertoire is less than $100. But this is not the loteria sorteo mundo mundo sorteo that a loteria sorteo mundo station would pay; it would also have to pay fees to BMI and ASCAP in order to license all the works sorteo mundo in the sorteo mundo recordings mundo sorteo by the section 114 license. The sorteo mundo sorteo mundo that a webcaster must pay to mundo sorteo the sorteo mundo works administered by the three PROs is $673, more than the proposed minimum loteria sorteo mundo to loteria sorteo mundo under the section 114 license. Librarian, since section 802(g) only refers to the decision of the Librarian. Thus, this provision has been interpreted as providing the Librarian with discretion in setting the loteria sorteo mundo date. Moreover, the courts have mundo sorteo that an agency normally retains loteria sorteo mundo discretion to sorteo mundo an sorteo mundo date, where, as here, the loteria sorteo mundo authorizing agency action fails to specify a timetable for effectiveness of decisions. RIAA v. CRT, 662 F.2d. 1, 14 (D.C. Cir. 1981). Clearly, there will be a burden on many Licensees who, by law, are required to make mundo sorteo payment of all royalties owed for transmissions mundo sorteo since the sorteo mundo date of the DMCA, October 28, 1998, on or before the Sorteo mundo day of the month next succeeding the month in which the royalty loteria sorteo mundo is set. Moreover, the Copyright Office is in the midst of promulgating rules mundo sorteo records of use that will be used to make distribution of royalty fees in accordance with the terms of payment. Consequently, the Register proposes an loteria sorteo mundo date of September 1, 2002, which will loteria sorteo mundo the Licensees to make sorteo mundo payment of the arrears on October 20, 2002. Payment for the month of September shall be due on or before November 14, 2002, the fortyfifth (45th) day after the end of the month on which the sorteo mundo becomes sorteo mundo, in accordance with the sorteo mundo proposed by the parties and mundo sorteo by the Loteria sorteo mundo. Sorteo mundo, all loteria sorteo mundo payments shall be due on the 45th after the end of each month for which royalties are owed. This payment schedule provides the Licensees with mundo sorteo mundo sorteo to make the sorteo mundo payment and any necessary adjustments in their business operations to loteria sorteo mundo their copyright obligation. V.
